Terms of Use

These Terms of Use (“Terms”) apply to your use of Sleep Sounds: Rain & Spa (the “App”) and its related support pages. By using the App, you agree to these Terms to the extent permitted by applicable law.

1. App Store license

If you obtain the App through Apple’s App Store, your license to the App is also subject to Apple’s applicable App Store terms and Apple’s Standard Licensed Application End User License Agreement unless a custom EULA is separately provided in App Store Connect. The App is licensed, not sold.

2. Permitted use

You may use the App for personal, lawful, non-commercial listening and relaxation purposes on devices you own or control, subject to Apple’s usage rules and applicable law.

You may not misuse the App, interfere with its operation, attempt unauthorized access, redistribute protected App content, or reverse engineer the App except where such a restriction is prohibited by applicable law or allowed by applicable open-source licenses.

3. Sleep, wellness, and safety

The App provides ambient audio, rain, nature, spa, relaxation, mixing, timer, and related convenience features. It is not a medical device, medical service, emergency service, alarm, or substitute for professional medical advice, diagnosis, or treatment.

Do not use the App in situations where audio may reduce your ability to hear warnings or where sleep-inducing or relaxing content could create a safety risk, including while driving, cycling in traffic, operating machinery, or performing tasks that require full attention.

Do not rely on the App as your only alarm, safety alert, baby monitor, emergency notification system, or critical timer.

4. Audio and content

The App and its included or downloadable sounds, artwork, text, software, and other content are owned by or licensed to the App provider and are protected by applicable intellectual-property laws. Your license is for use through the App and does not grant ownership of the underlying content.

5. Offline downloads and availability

Downloaded or cached sounds may be removed, replaced, become unavailable, or require re-download due to storage limits, App updates, licensing changes, technical issues, or service changes. We do not guarantee permanent availability of any particular sound or download.

6. Advertising and paid features

The App is offered free of charge. As of this version, the App does not display advertising and does not offer any in-app purchase. A future version may display advertising and may offer an optional paid Remove Ads / Premium feature consistent with the App's free, ad-supported model. Any purchases made through Apple are processed by Apple and are subject to Apple's purchase, billing, renewal, cancellation, and refund rules.

If an auto-renewable subscription is offered, the App and App Store listing will disclose the subscription duration, price, renewal terms, and links to applicable Terms of Use and Privacy Policy.

7. Third-party services

The App may rely on Apple services or other third-party infrastructure for functions such as App distribution, payments, content delivery, advertising, or diagnostics. Third-party services are governed by their own terms and privacy practices where applicable.

8. Updates and changes

We may update, improve, modify, suspend, or discontinue features when reasonably necessary. App updates may be required to maintain compatibility, security, or functionality.

9. Disclaimer

To the maximum extent permitted by applicable law, the App is provided on an “as is” and “as available” basis without warranties beyond those that cannot legally be excluded. We do not guarantee uninterrupted operation, specific sleep outcomes, health benefits, or that the App will be error-free.

10. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the App. Nothing in these Terms limits rights or remedies that cannot legally be limited.

11. Suspension or termination

Your right to use the App may end if you materially violate these Terms. You may stop using the App at any time by deleting it.

12. Privacy

Your use of the App is also governed by our Privacy Policy and Privacy Choices & Data Deletion page.

13. Changes to these Terms

We may update these Terms to reflect changes in the App, legal requirements, or business practices. The “Last updated” date will be revised when changes are published.
