By downloading, accessing, purchasing through, or using the App, you agree to these Terms and to any applicable terms imposed by the platform through which you obtained the App.
If you do not agree to these Terms, you should not use the App.
1. About the App
Phlebotomy CPT Exam Prep is an independent educational application designed to assist users who are studying phlebotomy-related concepts and preparing for certification examinations.
The App may include educational study guides, practice questions, mock examinations, progress tracking, review tools, saved questions, wrong-answer review, domain performance information, and other learning features.
2. Independent Exam Preparation Resource
Phlebotomy CPT Exam Prep is independently developed and operated.
The App is not affiliated with, endorsed by, sponsored by, authorized by, or officially connected with the National Healthcareer Association (NHA).
References to NHA, CPT certification, certification examinations, credentials, or examination topics are used solely to describe the educational and exam-preparation purpose of the App.
All third-party trademarks, certification names, and organization names remain the property of their respective owners.
3. Educational Purpose Only
The App is provided solely for educational, study, and exam-preparation purposes.
The App does not guarantee that you will:
- Pass any certification examination
- Meet examination eligibility requirements
- Receive any professional certification or credential
- Obtain employment
- Meet employer or regulatory requirements
Examination content, eligibility criteria, standards, procedures, and certification requirements may change over time.
You are responsible for consulting the applicable official certification organization and other authoritative sources for current examination and eligibility requirements.
4. No Medical or Professional Advice
The App does not provide medical advice, diagnosis, treatment, emergency guidance, or professional healthcare services.
Educational content within the App should not replace professional judgment, supervised clinical training, employer procedures, institutional policies, official manufacturer instructions, applicable laws, regulations, or current standards of practice.
In an actual clinical or emergency situation, users should follow applicable professional protocols and obtain appropriate guidance from qualified professionals.
5. License and Apple App Store Terms
The App is licensed to you, not sold to you.
If you obtained the App through the Apple App Store, your use of the App is also subject to Apple's applicable App Store terms, usage rules, and Licensed Application End User License Agreement.
Unless a separate custom end-user license agreement is expressly provided through the applicable App Store listing, Apple's Standard Licensed Application End User License Agreement applies to the license for the App.
You receive a limited, personal, non-exclusive, non-transferable right to use the App on devices that you own or control, subject to these Terms and applicable platform rules.

6. Free and Premium Access
The App may provide certain features or content without charge and may reserve additional features, content, questions, study tools, or functionality for Premium users.
The specific features available under Free and Premium access may be displayed within the App.
Access to Premium functionality requires a valid eligible purchase, subscription entitlement, promotional entitlement, or other authorized Premium access.
7. Premium Purchase Options
The App currently intends to offer the following Premium purchase options in the United States:
- Monthly Premium: US$13.99 per month — auto-renewable subscription
- Three-Month Premium: US$29.99 every three months — auto-renewable subscription
- Lifetime Premium: US$49.99 — one-time non-consumable purchase
Prices displayed in the App Store purchase interface are the authoritative prices for your storefront and transaction. Prices may vary by country or region, currency, applicable taxes, exchange rates, and App Store pricing.
8. Auto-Renewable Subscriptions
Monthly Premium and Three-Month Premium are auto-renewable subscriptions.
When you purchase an auto-renewable subscription, payment is processed through your Apple Account and the subscription automatically renews for another subscription period unless it is cancelled in accordance with Apple's subscription management procedures.
The Monthly Premium subscription renews on a monthly basis.
The Three-Month Premium subscription renews at the end of each three-month subscription period.
The renewal price shown by Apple at the time of purchase, renewal, or an applicable authorized price change governs the transaction.
9. Managing or Cancelling a Subscription
Subscription billing and cancellation are managed through Apple.
You may manage or cancel an eligible subscription through your Apple Account subscription settings.
Deleting the App from your device does not by itself cancel an active subscription.
After cancellation, Premium subscription access generally remains available until the end of the applicable paid subscription period, subject to Apple's billing and subscription policies.
10. Lifetime Premium Purchase
Lifetime Premium is intended as a one-time non-consumable In-App Purchase.
It is not an auto-renewable subscription and does not create recurring subscription billing.
A valid Lifetime Premium purchase provides access to the Premium features included with that entitlement for the supported life of the App, subject to these Terms, platform availability, compatibility, and applicable law.
"Lifetime" refers to the supported operational life of the applicable App and Premium entitlement. It does not guarantee that the App, any particular device, operating system version, App Store service, or individual feature will remain available indefinitely.
11. Restore Purchases
The App provides a Restore Purchases function for eligible purchases associated with your Apple Account.
Purchase restoration is processed using Apple's App Store services and is subject to Apple's purchase and account systems.
Restoration requires that Apple recognize the applicable purchase or entitlement as eligible for restoration.
12. Billing
Purchases made through the Apple App Store are billed and processed by Apple.
We do not directly process your complete payment card number or bank account information for Apple In-App Purchases.
You are responsible for maintaining valid payment information associated with your Apple Account where required.
13. Refunds
Purchases made through the Apple App Store are subject to Apple's applicable refund policies and procedures.
We do not independently control Apple's decision to approve or deny a refund request.
Users seeking a refund for an Apple App Store transaction should use the refund or purchase-support options provided by Apple.
Nothing in these Terms limits any mandatory consumer rights that cannot lawfully be excluded under applicable law.
14. Price Changes
Purchase and subscription prices may change in the future.
Any subscription price changes will be handled in accordance with applicable App Store requirements and Apple policies.
The price presented by Apple in the purchase interface or applicable subscription management interface is the controlling price for that transaction.
15. App Content and Accuracy
We make reasonable efforts to provide useful and accurate educational content.
However, educational, scientific, regulatory, clinical, examination, and certification information may change over time, and errors or omissions may occur.
We do not represent or warrant that every question, explanation, study guide, reference, score, or other item of content will always be complete, error-free, current, or applicable to every situation.
16. Practice Questions and Examination Content
Practice questions and study materials within the App are intended for educational preparation.
Unless expressly stated otherwise, practice content is not represented as actual confidential examination material and should not be interpreted as a reproduction of a current certification examination.
Users must not use the App to distribute, request, reproduce, or facilitate unauthorized disclosure of confidential examination content.
17. User Responsibilities
You agree to use the App lawfully and responsibly.
You may not:
- Use the App for unlawful purposes
- Attempt to interfere with the normal operation of the App
- Attempt unauthorized access to systems or services
- Misrepresent the App as an official NHA product
- Redistribute protected App content without authorization
- Use App content in a manner that infringes third-party rights
- Attempt to circumvent Premium purchase controls unlawfully
18. Intellectual Property
The App's original software, interface design, original practice content, explanations, study materials, graphics, branding, and other original materials are protected by applicable intellectual property laws.
Except as expressly permitted by law or written authorization, you may not reproduce, republish, sell, redistribute, license, or commercially exploit protected App content.
Third-party trademarks and names belong to their respective owners.
19. App Availability and Changes
We may update, improve, modify, add, remove, replace, or discontinue features or content when reasonably necessary.
Availability may depend on device compatibility, operating system requirements, App Store availability, network services, and technical factors outside our control.
We do not guarantee uninterrupted or error-free availability of every feature at all times.
20. Local Study Data
Certain study information may be stored locally on your device, including progress, scores, bookmarks, wrong-answer history, saved questions, and in-progress study sessions.
You are responsible for maintaining appropriate device security and backups.
Removing the App, clearing App data, device failure, device replacement, or operating system actions may result in loss of locally stored information where no compatible backup or restoration mechanism is available.
21. Privacy
Your use of the App is also subject to our Privacy Policy.

22. Third-Party Services
The App may rely on services provided by Apple or other platform providers for functionality including App distribution, purchases, subscriptions, restoration, operating system services, and related functionality.
Third-party services are subject to their own terms, availability, and privacy practices.
23. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the App and its content are provided on an "as is" and "as available" basis.
We do not guarantee that the App will meet every user's requirements or that all content will always be complete, current, uninterrupted, or error-free.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
24. Limitation of Liability
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, or similar losses arising from use of or inability to use the App, reliance on educational content, loss of locally stored study progress, or examination outcomes.
These limitations do not apply where liability cannot legally be limited or excluded.
25. Termination
You may stop using the App at any time.
Rights granted under these Terms may terminate if you materially violate these Terms, subject to applicable law and platform requirements.
Termination of your right to use the App does not automatically create a right to a refund for an App Store transaction.
26. Changes to These Terms
We may update these Terms from time to time to reflect changes to the App, Premium offerings, legal requirements, or platform requirements.
Updated Terms will be published on this page with a revised effective or last-updated date.
Your continued use of the App after revised Terms become effective constitutes acceptance to the extent permitted by applicable law.
27. Governing Requirements
These Terms are intended to operate subject to applicable law, mandatory consumer-protection rights, and applicable App Store terms and policies.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

29. Entire Agreement
These Terms, together with the Privacy Policy and applicable platform terms, constitute the applicable agreement regarding your use of the App, except where additional legally binding terms expressly apply.
